The August-September 2008 edition of The Small Business Advocate reviews six months of progress on the top 10 federal rules most in need of review and reform, as part of Advocacy?s r3 initiative.
On August 20, 2008, the Department of Homeland Security?s U.S. Citizenship and Immigration Services (USCIS) proposed substantial changes to requirements affecting H-2B visas (visas for temporary non-agricultural workers).? The changes would affect employers seeking temporary workers and are predominantly used by employers obtaining landscape laborers, housekeeping cleaners and construction workers. The proposed rule would allow employers to petition for unnamed workers (as opposed to listing specific individuals) and would lower the amount of time that H-2B worker must remain outside the United States before he or she would be eligible to reapply again for a H-2B visa (from 6 months to 3 months). Among the other requirements, employers would be required to promise or attest that they are complying with the H-2B program and that the workers are not paying fees for their H-2B visa (or the employer would be required to reimburse them for these fees). Comments are due on September 19, 2008.

On August 21, 2008, The Office of Advocacy of the U.S. Small Business Administration (?Advocacy?) filed a letter with the Federal Communications Commission (?FCC? or ?Commission?) commenting on OrbitCom?s petition for forbearance of Sections 61.26(b) and 61.26(c) of the FCC?s rules. The forbearance process allows a carrier to seek regulatory relief from certain FCC rules.
On August 19, 2008, the Office of Advocacy (Advocacy) sent a letter to Senator Olympia J. Snowe in support of legislation she introduced, the Home Office Deduction Simplification and Improvement Act of 2008, S. 3371. The bill creates a standardized home office tax deduction.
Regulatory expert Jamie Belcore has joined the Office of Advocacy of the U.S. Small Business Administration. As a full-time regulatory attorney, she will monitor federal agency compliance with the Regulatory Flexibility Act. Belcore was formerly a Mercatus Regulatory Studies Fellow at the Office of Advocacy.
